We at DJ Shinski are committed to protecting your privacy. This Privacy Policy explains our data processing practices and your options regarding the ways in which your personal information is used. If you have objections to the Privacy Policy, you should immediately discontinue use of the Website and Services offered by us.
1. DEFINITIONS
References to the "Services" mean, collectively, those services made available via the Website, including DJ mix downloads, blog content, video content, contact forms, and email subscriptions.
References to "us", "we", "our", and/or "DJ Shinski", mean DJ Shinski, the brand, including any and all trade names utilized thereby.
References to the "Website" mean, collectively, the Website bearing the URL djshinski.com as well as any other site or social media page operated by us.
References to "you", and/or "User", mean the user of the Website and/or the user of our Services.
2. GENERAL
The following outlines the Privacy Policy but it is to your benefit to read the specific elements that follow below and are set forth in more detail in this Privacy Policy:
- Before or at the time of collecting personal information, DJ Shinski will identify the purposes for which information is being collected.
- DJ Shinski will collect and use personal information solely with the objective of fulfilling those purposes specified by DJ Shinski and for other compatible, legitimate purposes, unless DJ Shinski obtains the consent of the individual concerned or as required by law.
- DJ Shinski will only retain personal information as long as necessary for the fulfillment of those purposes.
- DJ Shinski will collect personal information by lawful and fair means and, where appropriate and/or legally required, with the knowledge or consent of the individual concerned.
- Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.
- DJ Shinski will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification.
- DJ Shinski will make readily available to customers information about DJ Shinski's policies and practices relating to the management of personal information.
- DJ Shinski is committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained.
3. AGREEMENT TO BE BOUND
The following Privacy Policy governs the collection and use of private information via the Website or through our Services. By accessing the Website and/or utilizing our Services, you represent that you have read and understand the Privacy Policy and that you agree to be bound thereby.
This Privacy Policy may be additionally subject to our Terms and Conditions.
4. MODIFICATIONS AND CHANGES TO PRIVACY POLICY
We may modify, add to, suspend, or delete the Privacy Policy, in whole or in part, at our sole discretion at any time, with such modifications, additions or deletions being effective thirty (30) calendar days following their posting to the Website and emailing a notice to registered Users. Your use of the Website and/or use of our Services, after modification, addition or deletion of the Privacy Policy shall be deemed to constitute acceptance by you of the modification, addition or deletion.
5. THE INFORMATION WE COLLECT
DJ Shinski does not collect information about its users from third-party sources, such as public records or entities, or private organizations.
We collect both personally-identifiable information or personal data and non-personally-identifiable information from you. Often, you choose what information to provide to us, but, sometimes, we may require certain information for you to use and for us to provide the Services. Specifically, we collect the following:
Registration & Account Set Up
In order to register Users for our services, we collect your full name and email via Clerk authentication. We may also collect and connect to your social media profiles using your name and social media ID, should you choose to connect such profiles to our Services. We also will collect a user ID and password.
Contact Form Submissions
When you submit a contact form, we collect your name, email address, phone number (optional), inquiry type, event date (for booking inquiries), information about how you heard about us, and your message content.
Email Subscriptions
We collect email addresses for newsletter subscriptions and email notification preferences. We store your Plunk contact ID to manage your email subscription status and preferences.
Download Tracking
We track your DJ mix download history, including which mixes you have downloaded and when, to provide you with personalized recommendations and to improve our service.
Automated Information
DJ Shinski uses web-based analytics (PostHog) to automatically receive and record information from each User's browser or your mobile device when you visit the Website or use the Services, such as your IP address in an anonymized fashion or unique device identifier, cookies and data about which pages you visit in order to allow us to operate and provide the Website and Services. This information is stored by us and is collected automatically. We may combine this information from your browser or your mobile device with other information that we or our partners collect about you. This information is used to prevent fraud and to keep the Website and our Services secure, to analyze and understand how the Services work for our Users, and to provide a more customized Website experience for all Users.
We may also automatically collect device-specific information when you access or use our Website or Services. This information may include information such as the hardware model, operating system information, browser information, IP address, and device identifiers.
Finally, we may collect additional analytics regarding the use of and interaction with our Services, including mix views, downloads, streaming platform clicks (YouTube, Spotify, Apple Music, SoundCloud, Mixcloud), filter preferences, search queries, video interactions, and merchandise clicks.
6. USE OF YOUR INFORMATION
We may use your personally-identifiable information to:
- Provide DJ mix downloads and access to content
- Process and respond to contact form inquiries
- Send email notifications based on your preferences
- Provide and improve customer service administration and support
- Personalize your User experience
- Contact Users via email regarding services and updates
- Send marketing communications about new mixes, foundation updates, merchandise drops, recommendations, live events, and DJ news (with opt-out options)
- Facilitate registration for and use of our Services
- Ensure legal compliance and prevent fraud
We may use your non-personally identifiable information to create traffic statistics for our Website and Services; to create User statistics for our Services; to improve customer service; and to personalize your User experience.
7. YOUR RIGHTS & PREFERENCES
You have the right to be informed about DJ Shinski's data collection processes. We fulfill this right by providing you with this Privacy Policy.
DJ Shinski gives you the choice of providing, editing, or removing certain information, as well as choices about how we contact you. Note that you may not be able to access all functionality of the Services should you choose to decline to provide some personal information.
You may change or correct your DJ Shinski account information through your account settings (log in required).
You can also request the deletion of the personal information via your account settings (log in required) or by emailing us at hi@djshinski.com.
Depending on your location, you may also have certain additional rights with respect to your information, such as:
- Data access and portability (including the right to obtain a copy of your personal data via your account settings)
- Data correction (including the ability to update your personal data via account settings)
- Data deletion (including the right to have DJ Shinski delete your personal information, except information we are required to retain)
- Withdrawal of consent or objection to processing (including the right to ask DJ Shinski to stop processing your personal data)
You may also control the receipt of certain types of communications from DJ Shinski. DJ Shinski may send you messages about the Services or your activity. Some of these messages are required, service-related messages for Users (such as transactional messages or legal notices). Other messages are not required, such as newsletters and marketing emails. You can control which optional messages you choose to receive via notification settings in your account or the unsubscribe link in our emails.
If you no longer wish to use the Website or our Services or receive service-related messages (except for legally required notices), then you may close your account.
8. SHARING INFORMATION WITH THIRD PARTIES
DJ Shinski does not sell, rent, lease, trade, or otherwise give away its customer lists to third parties. DJ Shinski may share your data only with those third-parties who may be necessary to provide the Services and process your data. We utilize third-party service providers and vendors to provide our Website and Services, which are subject to change at any time:
- Clerk - Authentication and user management. We share your email, name, and profile information with Clerk to manage your account and authentication.
- Convex - Database and file storage. We store all user data, mix files, download history, and content in Convex's secure infrastructure.
- PostHog - Analytics and user behavior tracking. We share anonymized usage data, page views, interactions, and device information with PostHog to improve our services.
- Plunk - Email marketing and transactional emails. We share your email address and contact ID with Plunk to send you newsletters, notifications, and marketing emails based on your preferences.
- YouTube - Video content integration. We embed YouTube videos and may share viewing data with YouTube in accordance with their privacy policy.
- Cloudflare - Content delivery network and workers for download handling. We may share download request data with Cloudflare to facilitate file delivery.
- Vercel - Website hosting and deployment. We use Vercel to host our website and may share technical data for performance monitoring.
DJ Shinski may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on DJ Shinski or the Website; (b) protect and defend the rights or property of DJ Shinski; (c) in the event DJ Shinski reasonably believes you have used the Services to commit fraud or copyright infringement or have otherwise violated our Terms and Conditions of use; and/or (d) act under exigent circumstances to protect the personal safety of users of DJ Shinski, or the public.
9. USE OF COOKIES; USER SESSION INFORMATION
The DJ Shinski Website may use "cookies", activity tracking, and other personalized features to help you personalize your online experience. A cookie is a text file that is placed on your device by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.
One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize DJ Shinski pages or register with the DJ Shinski site, a cookie helps DJ Shinski to recall your specific information on subsequent visits. This simplifies the process of recording your personal information. When you return to the same DJ Shinski Website, the information you previously provided can be retrieved, so you can easily use the DJ Shinski features that you customized. Generally speaking, cookies do not contain personal information from which you can be identified, unless you have furnished such information to the Website.
You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the DJ Shinski Services or Websites you visit.
User session information, including identification and length (a randomly generated identification created for each time you use the Website, and the amount of time you use the Website, in a single session), helps DJ Shinski to manage subscriptions and deliver customized content based on User-specific information. DJ Shinski may use this information in aggregated form in order to improve future development of the Website.
10. SECURITY OF YOUR PERSONAL INFORMATION
DJ Shinski secures your personal information from unauthorized access, use, or disclosure by restricting the same to management-level access, utilizing secure sockets layers (SSL), and encrypting your data.
We strive to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed. Please note that non-encrypted communication using email is not secure. Thus, we cannot guarantee data security in email communication.
11. INTERNATIONAL TRANSFER
We offer a US-based service. Thus, your information will be transferred to and processed in the United States. The United States, Canada, Australia, the United Kingdom, the European Economic Area ("EEA") Member States, Switzerland, Brazil, and other countries all have different privacy and cybersecurity laws. When your information is moved from your home country to another country, the laws and rules that protect your personal information in the country to which your information is transferred may be different from those in the country in which you live.
12. CHILDREN UNDER THIRTEEN; NOTICE TO MINORS
DJ Shinski does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use the Website and Services. We request that all users of the Website and our Services who are under the age of thirteen not disclose or provide any personally-identifiable information. If we discover that a child under thirteen has provided us with personally-identifiable information, we will delete that child's personally-identifiable information from our records. You are responsible for any and all account activity conducted by a minor under your account.
In addition to protecting the privacy of children under age thirteen we are committed to protect the privacy of minors. Though neither our Website nor our Services is targeted to minors nor is it intended to be used by minors, if, for any reason a minor has shared information via our Website and/or Services said minor may request and obtain removal of such information by contacting us at hi@djshinski.com or by deleting his or her account. Although we offer deletion capability, you should be aware that the deletion of an account may not ensure complete or comprehensive removal of information provided.
13. DO NOT TRACK DISCLOSURE
Please note that while you may have the opportunity to opt-out of targeted advertising and you may be able to control the use of cookies through your Web browser, some Web browsers may also give you the ability to enable a "do not track" setting. This setting sends a special signal to the Websites you encounter while Web browsing. This "do not track" signal is different from disabling certain forms of tracking by declining cookies in your browser settings, as browsers with the "do not track" setting enabled still have the ability to accept cookies. We do not respond to Web browser "do not track" signals at this time. If we do so in the future, we will describe how we do so in this Privacy Policy. 14. RETENTION
DJ Shinski will retain your information only for as long as is necessary for the purposes set out in this policy, for as long as your account is active (i.e., for the lifetime of your DJ Shinski account), as described in this policy, or as needed to provide the Services to you. If you no longer want DJ Shinski to use your information to provide the Services to you, you may close your account. DJ Shinski will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, enforce our agreements, and as otherwise described in this policy. We also retain log files for internal analysis purposes. These log files are generally retained for a brief period of time, except in cases where they are used for site safety and security, to improve site functionality, or we are legally obligated to retain them for longer time periods.
15. E-MAIL COMMUNICATIONS; HOW TO OPT-OUT
It is DJ Shinski's policy not to send unsolicited emails or allow third parties to contact you via the email address that you provide to DJ Shinski.
You can control what information we send you via your account settings (log in required), and may unsubscribe from marketing emails at any time.
DJ Shinski may, from time to time, contact you to discuss matters relevant to your account and, naturally, DJ Shinski will contact you to respond to inquiries that you may send to DJ Shinski.
In addition, from time to time, DJ Shinski may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication related to new mix releases, foundation updates, merchandise drops, recommendations, live events, and DJ news.
Please note that our marketing and promotional communications are opt-in. This means that we will only send you such communications if you request them or based on your notification preferences. If you would like to stop receiving marketing or promotional communications via email from DJ Shinski, you may opt out of such communications by clicking on the UNSUBSCRIBE link or by adjusting your notification preferences in your account settings.
Email marketing campaigns published by us may contain tracking facilities within the actual email. Subscriber activity is tracked and stored in a database for future analysis and evaluation. Such tracked activity may include but shall not be limited to: the opening of emails, forwarding of emails, the clicking of links within the email content, times, dates and frequency of activity. This information is used to refine future email campaigns and supply the User with more relevant content based around their activity.
16. YOUR RIGHTS
You may benefit from a number of rights in relation to your information that we process. Some rights apply only in certain limited cases, depending on your location. If you would like to manage, change, limit, or delete your personal information, you can do so via your account settings or by contacting us. Upon request, DJ Shinski will provide you with information about whether we hold any of your personal information. By visiting your account settings, you can access, correct, change, and delete certain personal information associated with your account. In certain cases where we process your information, you may also have a right to restrict or limit the ways in which we use your personal information. In certain circumstances, you also have the right to request the deletion of your personal information, and to obtain a copy of your personal information in an easily accessible format. If we process your information based on our legitimate interests as explained above, or in the public interest, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons. Where we use your data for direct marketing purposes, you can always object using the unsubscribe link in such communications or changing your account settings.
17. SPECIAL NOTICE TO CALIFORNIA RESIDENTS – NOTICE AT COLLECTION
This Privacy Notice for California Residents - Notice at Collection supplements the information contained in our privacy policy above and applies solely to all visitors, users, and others who reside in the State of California ("consumers" or "you"). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and its November 2020 amendment. Any terms defined in the CCPA have the same meaning when used in this notice.
In addition to the CCPA, we adhere to the requirements of other state privacy laws, including Virginia, Colorado, Connecticut, and Utah.

- As described to you when collecting your personal information or as otherwise set forth in the CCPA.
We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

Your Rights and Choices

Access to Specific Information and Data Portability Rights
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

- The categories of sources for the personal information we collected about you.
- Our business or commercial purpose for collecting that personal information.

Deletion Request Rights

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

Exercising Access, Data Portability, and Deletion Rights
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by emailing hi@djshinski.com. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information.
Response Timing and Format
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. Any disclosures we provide will only cover the twelve- (12-) month period preceding the verifiable consumer request's receipt.
Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of goods or services.
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. 18. WITHDRAWING CONSENT
Where you have provided your consent, you have the right to withdraw your consent to our processing of your information. For example, you can withdraw your consent to email marketing by using the unsubscribe link in such communications or by changing your account settings. You can choose to withdraw your consent to our processing of your information at any time by closing your account and then emailing hi@djshinski.com to request that your personal information be deleted, except for information that we are required to retain. This deletion is permanent, and your account cannot be reinstated.
